On May 20, 2025, Washington enacted Senate Bill 5217 (SB 5217), a sweeping update to the state’s workplace accommodation laws for pregnancy related needs. The purpose of SB 5217 is to expand protections for pregnant and postpartum employees, ensuring equitable treatment and support in the workplace. This law significantly broadens employer obligations under the Healthy Starts Act and introduces new requirements that apply to all employers, regardless of size or non-profit status.
Effective Date and Key Provisions
Although SB 5217 does not take effect until January 1, 2027, businesses should begin preparing now. The law mandates paid lactation breaks, including travel time if no private space is available onsite, and prohibits employers from requiring employees to use PTO for these breaks. It also expands reasonable accommodations to include flexible scheduling for both prenatal and postpartum medical visits, modified duties, seating, and lifting limits. Importantly, employees will not need to provide medical documentation to request these accommodations.
Compliance and Enforcement
The enforcement authority shifts from the Attorney General to the Washington Department of Labor & Industries (L&I), which will investigate complaints and impose civil penalties for noncompliance. Employees also gain a private right of action to recover damages and attorneys’ fees. These changes mean that failure to comply could result in significant financial and reputational risk for employers.
